THE HISTORY OF “NORAD SANTA TRACKING”
The history of NORAD Tracks Santa started in 1955 with a typo in a SEARS ad that mistakingly directed kids to the Continental Air Defense Command also known as “CONAD”. Colonel Harry Shoup played along when he took a child’s call who asked to speak with Santa, and the tradition grew, becoming a beloved holiday outreach for NORAD after its formation in 1958. Using military tech to track Santa’s journey with help from volunteers and sponsors from around the globe, Santa’s annual flight will be seen by millions who await the news that he can be seen heading for their town as children jump into bed! CAN SANTA BE CHARGED WITH BREAKING AND ENTERING?????
No, Santa likely wouldn’t be charged with breaking and entering because he has implied consent to enter homes, evidenced by cookies, stockings, and gift requests, and crucially, his intent is to give gifts, not commit theft or a felony inside, which are key elements for burglary charges. While technically he’s entering private property without permission, the traditional act of leaving milk and cookies serves as a clear, non-verbal invitation, negating criminal intent and establishing a defense for Santa.
Why Santa is Likely Innocent:
Implied Consent: Leaving out milk, cookies, or writing a letter to Santa acts as an invitation, giving him permission to enter, making him a licensee or invitee rather than a trespasser.
- Lack of Criminal Intent: Burglary requires intent to commit a felony or theft upon entry; Santa’s intent is purely benevolent (delivering presents).
- “Breaking” is Obsolete: Chimneys, unlocked doors, or even magical entry aren’t considered “breaking” in the traditional sense, especially with consent.
- Potential Legal Hurdles (If We Ignore the Magic):
- Trespassing: Without consent, entering a home is trespassing.
- Animal Cruelty/Endangerment: Animal rights groups might question the welfare of the reindeer.
- Air Traffic Violations: Flying a sleigh without a license, flight plan, or radio could be an issue.
- In essence, the spirit of Christmas and the explicit actions of homeowners (cookies, lists) provide Santa with a strong legal defense against burglary charges.

WHAT IS THE DEFCON LEVEL WHILE SANTA IS IN FLIGHT?
The United States military’s DEFCON level does not change when Santa enters restricted airspace. Santa’s flight is a special, approved event that does not constitute a threat to national security.
The North American Aerospace Defense Command (NORAD) and the Federal Aviation Administration (FAA) grant Santa Claus special flight and launch permissions each year. His entry into airspace, including restricted areas, is pre-approved and coordinated, not an unauthorized incursion that would necessitate an increase in the defense readiness condition (DEFCON).
Instead of a DEFCON change, NORAD treats Santa’s flight as a unique, non-hostile mission. NORAD uses its regular North Warning System radar network and infrared satellite systems (which detect Rudolph’s nose heat signature) to track his progress around the globe.
- U.S. and Canadian fighter jets (F-15s, F-16s, F-22s, and CF-18s) are scrambled to intercept and “escort” Santa as he travels through North American airspace, a festive tradition that also serves as a training exercise for aerospace readiness.

HOW DOES SANTA GET TO EVERY HOME ON CHRISTMAS EVE?
Santa gets to every house using a magical, super-fast sleigh pulled by flying reindeer, bending physics through time dilation or quantum effects (like superposition) to visit billions of homes in one night, often with help from elf-tech or subcontracted delivery teams. He navigates time zones, entering homes via chimneys, doors, or even magic portals, powered by belief and cookies, to deliver presents.
