The VA expands access to care and benefits for some former service members who did not receive an honorable or general discharge, amending its regulations regarding character of discharge expanding access to VA care and benefits for some former service members discharged under other than honorable conditions or by special court-martial.
When former service members with other than honorable discharges and bad conduct discharges (adjudged at special court-martial) apply for VA benefits and services, we carefully review their records to determine if we can provide them the requested care and benefits. This process helps ensure that VA can provide services to deserving former service members – including certain individuals who faced discrimination, survived sexual assault or harassment, struggled with their mental or physical health, or faced other challenges while serving in the military.
VA’s new regulation will expand access to care and benefits for certain former service members by:
- Eliminating the regulatory bar for “homosexual acts involving aggravating circumstances or other factors affecting the performance of duty” as a bar to benefits. While VA had already taken steps to ensure full and fair for former service members discharged based on homosexual conduct, gender identity, or HIV status, this move further solidifies VA’s commitment to reducing disparity for these groups in the adjudication process.
- Creating a “compelling circumstances exception” for certain former service members: For certain former service members discharged for “willful and persistent misconduct” or an “offense involving moral turpitude,” VA will now consider and determine if a compelling circumstances exception will permit VA to nonetheless provide care and services. Under this exception, VA will consider the former service member’s length and character of service, mental and cognitive impairment, physical health, combat-related hardship, whether the person was the survivor of sexual abuse/assault or discrimination, and more. This new exception creates a new path for VA to provide benefits and services to deserving former service members.
- Opening the door for previously denied service members to reapply: Because of these changes, former service members previously found ineligible for VA services may now be eligible for benefits and are encouraged to re-apply.
VA encourages former service members with other than honorable discharges and bad conduct discharges (adjudged at special court-martial) to for VA care and benefits today. Over the past 10 years, VA’s eligibility determination rate for these former service members has been 75% – meaning that VA provided care or benefits to 75% of them (57,000+ former service members).
“We encourage former service members with other than honorable discharges to apply for VA care and benefits today,” said VA Secretary Denis McDonough. “Although VA cannot change your discharge status, we want to provide you with any health care or benefits we can – and we will work with you every step of the way to do exactly that.”
“Too often, former service members believe that they cannot come to VA due to their discharge status – but the truth is that many former service members who were not discharged honorably can get health care or benefits from VA,” said Under Secretary for Benefits, Josh Jacobs. “When you apply – as with all VA benefits – we will do everything in our power to get to yes.”
VA has conducted extensive outreach to service members with other than honorable and bad conduct discharges adjudged at special court-martial in recent years, increasing the number who applied for VA care or benefits from approximately 1,700 in 2012 to more than 10,000 in 2023.
The VA character of discharge determination does not change the Armed Forces’ characterization of service and has no effect on the former Service member’s military discharge status. VA’s determination is for VA benefits and services eligibility purposes only.
Any discharge characterized as “honorable” or “general – under honorable conditions” satisfies the character of discharge requirement for basic eligibility for most VA benefits. Former service members who did not receive those discharges are not automatically disqualified from receiving VA care or benefits. However, barring a ruling of insanity, VA does not provide benefits to service members who are discharged with a “dishonorable discharge;” service members who were discharged for desertion, mutiny, going AWOL for 180 continuous days, or espionage; or service members discharged by sentence of a general court martial, discharged in lieu of trial, discharged as a “resignation by an officer for the good of the service,” or discharged as a conscientious objector. VA does apply a compelling circumstances exception for AWOL when appropriate.

PFC Bob Gray, at 99
Local veteran, WWII Army Veteran, PFC Bob Gray, turned 99 on Saturday. Gray served as an Infantryman from July 1943 to December 1946 in the U.S.Army, 26th Yankee Division; 104 Regiment, C Company. Gray saw combat in numerous battles, to include the Battle of Bulge and Normandy. His awards , besides WWII Victory medal and half dozen campaign medals , include Purple Heart and Bronze Star. Asked how he managed to get to 99, he told me, “first you have to get to tomorrow. Many tomorrows, live for the day”.
Family and friend packed in Ronnie’s restaurant in Burrillville, RI. Happy Birthday to PFC Bob Gray, you are a living hero!

Garden of Heroes
RI Lieutenant Governor Sabina Matos, Rhode Island Gold Star Families, the Rhode Island National Guard, the Rhode Island Office of Veterans Services, and state officials laid wreaths at the Garden of Heroes in honor of Rhode Island military members who lost their lives in service of our country this week. Gold Star Father Richard August provided the invocation, and remarks by Gold Star Mother Sharon Serio-Valente.
The Garden of Heroes was dedicated in 2005 and is managed by the Office of the Lieutenant Governor. Each May, the Lieutenant Governor holds a memorial wreath laying ceremony to honor Rhode Island service members who have made the ultimate sacrifice for their country since September 11, 2001.

Rolling Remembrance: Cranston, Rhode Island 61st Stop of 64 Realy Of 14,000 Mile Relay of American Flag Flown In Combat
On March 25, 2024, PepsiCo drivers began a relay that would cover 14,000 miles “Rolling Remembrance”. The relay is conducted annually to bring awareness and funds for Children of Fallen Patriot Foundation, https://www.fallenpatriots.org/. The lag and the trailer arrived on Monday in Cranston, the 59th stop of the relay that started in Seatle, Washinton on March 21, 2024.
All the drivers of the relay were PepsiCo’s drivers who served in the U.S Armed forces, or currently are. In attendance, was Governor Dan McKee and Mayor Ken Hopkins, Mayor of Cranston.
According to Children of Fallen Patriot Foundation, 52% of surviving spouses make less than $50,000. Additionally, VA benefits to children of the fallen patriots do not cover all the expenses for the deceased veteran’s children education. The event has raised over $9 million dollars in the last 9 years.
From Cranston, RI, PepsiCo driver, Karl Dence, U.S Army, Military Police veteran, will be the relay’s driver to Albany, New York. “It’s an honor and privilege to be one of the drivers,” Karl Dence.
VFW Post 152, N. Kingstown RI provided the honor guard.
Dan Dyer, from East Greenwich, RI , U.S Coast Guard, PepsiCo veteran employee was master of ceremonies. In his opening comments, he gave special recognition to 97 year old WWII Veteran, George Silva from Exeter, RI.
PepsiCo recognizes the importance of giving recognition to veteran employees and the impact companies like PepsiCo can make for veterans and their families. The relay is run in partnership with PepsiCo’s employee resource group,

Providence Children’s Museum Offers Free Admission to Active Military Families This Summer
Providence Children’s Museum (PCM) is thrilled to announce its participation in the Blue Star Museums program this summer. The national initiative, a collaboration between the National Endowment for the Arts, Blue Star Families, and the Department of Defense, provides free admission to all currently serving U.S. military personnel and their families from Armed Forces Day, Saturday, May 18, 2024, through Labor Day, Monday, September 2, 2024.
“We are honored to join museums nationwide in recognizing the service and sacrifice of our active-duty military families,” said Caroline Payson, Executive director. “PCM is a wonderful place for families to explore, learn, and create together, and we’re excited to welcome military families for free this summer.”
“Military families love Blue Star Museums, and we couldn’t run this program without the National Endowment for the Arts and the museums across the nation who show they care by participating,” said Blue Star Families CEO Kathy Roth-Douquet. “Access to museums enriches military families, creates wonderful family memories, and helps us feel connected to our communities so that we can thrive and do the hard job we have to do for the country. I am delighted for us to launch the 14th year of this very special program.”
The free admission program is available for those currently serving in the United States Military—Air Force, Army, Coast Guard, Marine Corps, Navy, and Space Force, members of the Reserves, National Guard, U.S. Public Health Commissioned Corps, NOAA Commissioned Corps, and up to five family members. Qualified members must show a Geneva Convention common access card (CAC), DD Form 1173 ID card (dependent ID), DD Form 1173-1 ID card or the Next Generation Uniformed Services (Real) ID card for entrance into a participating Blue Star Museum.
Providence Children’s Museum serves children and adults of all backgrounds and from all communities. Its focus is on children, ages 1 to 11, and the adults who care for them by presenting hands-on, play-based exhibits and programs that explore arts, culture and science, technology, engineering, and math.

Italian American War Veterans of US (ITAM) Volunteer Opportunities:
Leave No Veteran Alone Program – Monday and Saturday, ITAM seeks volunteers to meet up at designated nursing homes to meet and socialize with veterans living at the facility. Veterans who are homeless or at risk of homelessness—and their family members, friends, and supporters—can make the call to or chat online with the National Call Center for Homeless Veterans, where trained counselors are ready to talk confidentially 24 hours a day, 7 days a week.

Free Golf, Goddard Park Golf Course Fee Exemption for Totally Disabled Veterans:
Rhode Island resident Veterans who have a 100% permanent and total, service-connected disability rating from the VA are exempt from paying any fees to play golf at the Goddard Park Golf Course. For more information call the Clubhouse at Goddard Memorial State Park from April 1st through the 3rd Saturday in November at 401-884-9834 or year-round at Division Headquarters at 401-667-6200.
Free Rhode Island Hunting and Fishing Licenses for 100% Disabled Veterans: A Veteran who has a 100% disability rating from the VA is eligible for free Rhode Island hunting and fishing licenses.
No cost licenses are available if you are:
· over 65 AND a Rhode Island resident
· a veteran with 100% disability status from the Department of Veterans Affairs
· a person with 100% total disability status from the Social Security Administration
To apply in person at DEM, please bring a photo ID and an ORIGINAL DOCUMENT OF THE FINAL DECISION(S). Office hours are 8:30 a.m. to 3:30 p.m. Monday through Friday. (directions)
To apply by mail, please complete an application and mail the application and a copy of your photo ID and the ORIGINAL DOCUMENT OF THE FINAL DECISION(S). Please allow two weeks for processing.

To purchase online, you will be required to certify that you have an ORIGINAL DOCUMENT OF THE FINAL DECISION(S). You will also be required to enter the date the decision expires. The Department will audit compliance with the certification and may, at any time, request a copy of the current DOCUMENT OF THE FINAL DECISION(S). Failure to submit the documentation by the date requested may result in the suspension of your fishing and hunting license. Also, Rhode Island General Law 11-18-1 prohibits giving false documents to an agent, employee, or public official. The penalty is a misdemeanor punishable by a fine of up to $1,000 or imprisonment up to one year.
Rhode Island Hunting and Fishing Benefits for Service Members and Veterans: Rhode Island offers several hunting and fishing benefits to Service members and Veterans. A short description of each is listed below. Applicants are required to show documentation proving eligibility when they apply:

Free Rhode Island State Park Passes for 100% Disabled Veterans: Rhode Island offers the State Park Disability Pass for use at any state-owned recreational facility to disabled Veterans who have a 100% service-connected disability rating from the VA.
The State Park Disability Pass authorizes free admission and parking but does not exempt the following:
· Licensing fees
· Camping fees
· Picnic table fees
· Specialized facility use fees
· Use of equestrian areas
· Performing art centers
· Game fields fees
· Mule shed fees
If the disabled Veteran cannot drive, the vehicle transporting the Veteran will not be charged.
Veterans must apply in person at the Rhode Island State Parks and Recreation Headquarters and are required to show official documentation (dated within the past year) from the VA that states they have a 100% service-connected disability.

John A. Cianci is a Veteran Service Officer. Retired, U.S. Army MSgt., Persian Gulf War and Iraq War combat theater.
